What is Inkasso? Debt collection agencies in Germany explained

"Inkasso" is one of those words that shows up in Germany without explanation — in a letter, on the phone, in an email. Here's the short version of what it actually means, before we get into a specific letter.

What does "Inkasso" literally mean?

"Inkasso" comes from Italian and simply means "collection" of money. In everyday German usage, it refers to the whole process: a company trying to collect an outstanding bill on someone else's behalf.

What is an Inkassobüro (debt collection agency)?

An Inkassobüro is a private company that collects outstanding claims on behalf of a creditor (e.g. a landlord, online shop, health insurer, or phone provider). Important: the agency itself is neither a court nor a government office. It acts on behalf of the original creditor and can charge additional, legally capped fees for its own work.

How does Inkasso relate to the original debt?

The usual sequence looks like this: first, the original creditor sends one or more reminders (Mahnung) themselves. If there's no response, the creditor often hands the claim over to a debt collection agency (or even sells it entirely). Only after that — if that still doesn't work — can a formal court dunning procedure follow, with an actual Mahnbescheid from the local court (Amtsgericht), and finally enforcement (Zwangsvollstreckung). An Inkasso letter is usually a middle step in this chain, not the beginning and not the end.

Is an Inkasso letter already a court proceeding?

No. A collection agency by itself can't set a court date or a legal deadline. The payment deadline stated in the letter is a request, not a legal deadline. That only changes with an actual Mahnbescheid from the Amtsgericht — a separate, official document.

What rights do you have as a debtor?

  • You may check the claim and dispute it in writing if you have doubts.
  • Collection fees are legally capped and scale with the size of the claim.
  • Claims expire under the statute of limitations — usually after 3 years, counted from the end of the year the claim arose.
  • You can ask for a payment plan if the claim is valid but you can't pay right now.
