Widerspruch — how and when to object to a German office's decision

A Bescheid arrives, and something doesn't add up — the amount seems too low, the application was rejected entirely, or the reasoning just seems wrong. In most cases, you can file a Widerspruch (objection). It sounds more formal than it actually is.

What is a Widerspruch, exactly?

A Widerspruch is an informal but deadline-bound statement to the office that you disagree with their decision. The office then has to review the case again. This is usually the first and simplest step, before things could even go to court.

When is it worth objecting?

  • The application was rejected even though you think the requirements are met.
  • The approved amount seems too low or miscalculated.
  • The reasoning relies on incorrect or outdated information (e.g. old income, wrong residence status).
  • Important documents seem to have been overlooked when the decision was made.

What's the deadline?

Usually one month from delivery of the Bescheid — this is stated exactly in the Rechtsbehelfsbelehrung at the end of the document. Important: the deadline often starts as early as four days after the date on the letter, not from when it actually reaches you (a legal delivery presumption). When in doubt, write earlier rather than risk being late.

How is a Widerspruch structured?

  • Reference – case number (Aktenzeichen) and date of the Bescheid, so the office knows right away what this is about.
  • Clear statement – a sentence like "hiermit lege ich Widerspruch gegen den Bescheid vom ... ein".
  • Reasoning – why you disagree with the decision, as specific as possible, referencing any attached proof.
  • Request for confirmation – a written confirmation of receipt is useful to keep for your own records.

A Widerspruch doesn't need legal language — a clear, factual text is entirely sufficient.

What happens after you file it?

The office reviews the case again. If they agree with you, the Bescheid gets amended (Abhilfe). If they stick with their decision, you get a Widerspruchsbescheid — which you can then challenge in the Sozialgericht (social court), if it concerns social benefits.
