Jobcenter Widerspruch Letter Template (Free Sample) — How to Appeal a Bescheid in Germany
You got a Bescheid from the Jobcenter you don't agree with, and before writing your own letter you want to see what an actual Widerspruch looks like. Here's a real template you can copy, the deadline that actually matters, and what to do differently if it's an Ausländerbehörde decision instead — the rules there are not the same.
The deadline: one month, no more
You have exactly one month to file a Widerspruch against a Jobcenter Bescheid, counted from the day it's officially considered delivered (§ 84 Abs. 1 SGG). If it was sent by regular mail, German law assumes it arrived 4 days after posting, unless you can show it actually arrived later — or never arrived at all (§ 37 Abs. 2 SGB X). Miss this deadline and the decision normally becomes final, even if it was wrong.
What actually has to be in a Widerspruch
Less than you might think. It doesn't need to be fully argued from day one — a short, clear statement that you're objecting, referencing the Bescheid's date and Aktenzeichen (case number), is enough to keep the deadline. The detailed reasoning can follow afterward. Filing a Widerspruch costs nothing, and you can even do it verbally at the Jobcenter ("zur Niederschrift") if writing isn't practical — though having it in writing is safer.

What to do after sending it
Send it in a way you can prove — registered mail, or hand it in at the Jobcenter and ask for a stamped confirmation of receipt. Keep a copy for yourself. The Jobcenter then has up to 3 months to decide on your Widerspruch; if they stay silent past that, you can escalate to the Sozialgericht (Untätigkeitsklage). You can add your detailed reasoning in a follow-up letter — it doesn't have to be in the first one.
What if it's an Ausländerbehörde decision instead?
This is where it gets more complicated, and this exact template will not work everywhere. Widerspruch against Jobcenter decisions is governed by social law (SGG) and works the same nationwide. Appeals against Ausländerbehörde decisions fall under general administrative law (VwGO) instead — and 10 out of Germany's 16 federal states have abolished the Widerspruch stage for this kind of decision entirely. In those states, you have to go straight to a Klage (lawsuit) at the Verwaltungsgericht, within one month — filing a Widerspruch there gets rejected as inadmissible, and by the time you find that out, your real deadline may already be gone.
The safe way to know which applies to you: look at the Rechtsbehelfsbelehrung at the very bottom of your own Bescheid. It will say explicitly whether you can file a Widerspruch or need to go straight to Klage, and where. Don't assume — check that exact wording on your own letter.
